Overview of Cannabis in Mississippi

Mississippi legalized medical cannabis through the Mississippi Medicinal Cannabis Act (SB 2095), approved on January 26th, 2022, and signed into law by Governor Tate Reeves on February 2nd, 2022, making it the 37th state in the U.S. to establish a regulated medical cannabis program. The law allows qualified patients to access medical cannabis while businesses can operate under state-issued licenses for cultivation, processing, dispensaries, transportation, testing, and disposal, with ownership limits of 10% per processing or cultivation license and up to four dispensaries per person or corporation. Because the law does not impose a statewide cap on the total number of licenses issued, Mississippi remains open to new market entrants as patient demand continues to rise.

The program launched sales on January 25th, 2023, with over 1,700 registered patients, growing to more than 62,000 by mid-2025, with roughly 350 new patients joining each week. As of 2025, the state oversees 168 dispensaries, 76 cultivation facilities, 14 processing facilities, 14 transportation entities, 3 disposal companies, and 3 testing labs. This level of infrastructure, combined with rapid patient growth, indicates a market that is still developing rather than fully saturated. Local municipalities control zoning, business hours, and operational rules, with some counties and cities opting out of participation, creating geographic opportunities in jurisdictions that permit cannabis businesses but have limited competition.. Patients may purchase up to 3.5 grams of cannabis up to six days per week if they meet qualifying conditions such as Parkinson’s, Huntington’s, HIV, or AIDS.

The Mississippi State Department of Health manages most cannabis business licensing, while the Mississippi Department of Revenue regulates dispensaries. All applicants must register with the Secretary of State before applying. This established regulatory structure provides operators with clearer expectations and a more predictable path to licensure compared to emerging or pilot programs in other states.

Retail sales have grown rapidly, reaching $11.2 million by the end of the 2023 fiscal year, $75.3 million in Fiscal Year 2024, and just under $118.7 million by the end of the 2025 fiscal year, with double-digit growth reported in each quarter.

Mississippi Cannabis License Types

Mississippi’s medical cannabis program issues licenses for several types of cannabis businesses, each regulated under state law. Individuals or companies may apply for the following license categories. Some license types are further divided into tiers based on size and scope.

  • Cultivation License
    Allows the holder to grow medical cannabis at a licensed facility. Ownership is limited to 10% per individual or corporation per cultivation license.
  • Processing License
    Authorizes the extraction, manufacturing, and production of medical cannabis products for distribution to licensed dispensaries. Ownership is limited to 10% per individual or corporation per processing license.
  • Dispensary License
    Permits the retail sale of medical cannabis to qualified patients. An individual or corporation may hold up to four dispensary licenses.
  • Transportation License
    Allows the secure transport of medical cannabis products between licensed cultivation, processing, testing, and dispensing facilities.
  • Testing Laboratory License
    Permits independent laboratories to test medical cannabis products for potency, contaminants, and compliance with state safety standards.
  • Disposal License
    Authorizes the proper handling and destruction of medical cannabis waste in accordance with state regulations.
  • Research Facility License
    Allows approved entities to conduct medical or scientific research involving cannabis under state oversight.
